EU Notifies Draft Amendment to Cosmetic Ingredient Annexes
On 8 July 2026, the European Commission notified the World Trade Organisation (WTO) of a draft regulation to amend Regulation (EC) No 1223/2009 on cosmetic products. The draft proposes changes to the annexes governing prohibited, restricted, and permitted substances based on their classification as carcinogenic, mutagenic, or toxic for reproduction (CMR).
The proposed amendment includes significant updates to several annexes. It would amend one existing entry and add 16 new substances to Annex II (prohibited substances). Additionally, one entry in Annex III (restricted substances) would be amended and two new substances added. Annex V (preservatives) is also targeted, with a proposal to add one new preservative entry and delete two existing ones.
The notification opens a comment period for WTO members, which is expected to close on 6 September 2026. This draft signals a substantial update to EU cosmetics compliance that could require brands to undertake reformulation, ingredient substitution, and safety assessment updates to ensure continued market access.
