SCCS Opinion on HC Red No. 18, OPSS Publishes Statutory Instrument for Cosmetics, FDA Updates MoCRA Guidelines

EU - SCCS Opinion on HC Red No. 18

On 10th December 2024, the EU SCCS (Scientific Committee on Consumer Safety) released its opinion on HC Red No. 18 (CAS 144459-49-9). A previous (2015) SCCS opinion found HC Red No. 18 to be safe at a maximum concentration of 1.5% in oxidative hair dyes. However, information gaps were identified on purity data. This data gap has since been fulfilled, triggering the new SCCS opinion. The previous conclusion that HC Red No. 18 was safe in oxidative hair dyes at concentrations up to 1.5% (inclusive) still stands - with an additional safe use concentration limit of 0.5% for non-oxidative hair dyes.

GB - OPSS Publishes Statutory Instrument for Additional Cosmetic Restrictions

On 17th December 2024, the GB OPSS (Office for Product Safety Standards) published the Statutory Instrument (SI), ‘The Cosmetic Products (Restriction of Chemical Substances) (No. 2) Regulations 2024’, which enters into force on 31st January 2025. 

64 ingredients are added to Annex 2 (prohibited ingredients). This is one less than the draft amendment of October 2024, which listed 65 substances. 2-(2-methoxyethoxy)ethanol; diethylene glycol monomethyl ether" (CAS 111-77-3) appeared on the draft but not the final SI. 

For Annex II entries from 1680 to 1730, deadlines are as follows:

Placing on the market: 20th April 2025

Making available: 20th October 2025.

For Annex II entries from 1731 to 1743, deadlines are

Placing on the market: 2nd September 2025

Making available: 2nd March 2026.

Kojic acid has been added to Annex 3 (restricted ingredients) with a maximum concentration of 1% in face and hand products with the following deadlines:

Placing on the market: 20th June 2025

Making available: 1st November 2025.

US - FDA MoCRA Guidance Updated

On 11th December 2024, the US FDA released an updated version of the ‘Guidance on the Registration and Listing of Cosmetic Product Facilities and Products’. This version, which updates existing FAQs and introduces some new FAQs, is open for comment until 13th January 2025.

The guidance (originally published in December 2023) exists to aid with MoCRA (Modernization of Cosmetics Regulation Act of 2022) compliance.
